The following notice pertains to Gym and Common Area amenity usage.

1. RISKS OF EXPOSURE AND TRANSMISSION: The COVID-19 pandemic, caused by the SARS-CoV-2 virus, is a worldwide risk to human health. SARS-CoV-2 is highly contagious and COVID-19 has a mortality rate many times greater than the flu. SARS-CoV-2 can spread easily and exponentially. While people of all ages are at risk of contracting COVID-19, the individuals especially at risk are: those with compromised immune systems; serious chronic medical conditions like heart disease, diabetes, and lung disease; and individuals over the age of Sixty-Five (65).
2. REPRESENTATION, AGREEMENT, AND ATTESTATION: By entering and/or using this Common Area facility that may otherwise be forced to remain closed due to the COVID-19 pandemic, you represent and attest to the following:
a. You can confirm that you:
i. Are currently healthy, not currently experiencing any signs or symptoms of COVID-19 and have not knowingly been exposed to someone with COVID-19 or travelled internationally in the last fourteen (14) days; OR ii. Have recently tested negative for COVID-19.
b. You understand that by entering and/or using this Common Area facility you could be exposed to SARS-CoV-2.
c. You agree to take all reasonable and necessary precautions to protect yourself and others from the spread of SARS-CoV-2, including, but not limited to the following:

i. You are aware of and agree to follow all Federal, State, and local laws and orders, including orders regarding face masks, even though such laws and orders may be changing rapidly.
ii. You agree and understand that it is your responsibility to exercise care to protect yourself, such as assessing your own risks, which may include: age; underlying health conditions; recent travel; possible exposure to SARS-CoV-2; doctor’s recommendations; and local, State, and Federal recommendations.
iii. You represent that: (i) to the best of your knowledge, you are not currently afflicted with, and have not knowingly, within the last fourteen (14) days, been in contact with someone afflicted with, COVID-19 and (ii) you are not experiencing a fever or signs of respiratory illness such as cough, shortness of breath or difficulty breathing, or other COVID-19 symptoms. iv. You believe that you are not likely to transmit SARS-CoV-2 or contract COVID-19. v. If you believe it necessary to touch surfaces or objects in the Common Area facilities, consider the risks of doing so. You are reminded that wearing protective gloves, face coverings, and washing and sanitizing your hands frequently are steps you can take to protect yourself and others. You agree to wipe down any equipment with disinfectant wipes after use. You agree to leave the windows and door open to allow ventilation. vi. After leaving this Common Area facilities, you will discard any gloves, disposable face coverings, or other disposable protective equipment worn during your visit in a trash can and will wash your hands with soap and water for at least twenty (20) seconds.

3. AGREEMENT, DECLARATION, AND ASSUMPTION OF RISK: By entering this Common Area facility you are declaring that: the foregoing is true; you agree to take all recommended and reasonable actions to protect yourself and others from exposure to SARS-CoV-2; you assume the risk of entering the Common Area facility of your possible exposure to SARS-CoV-2 or contraction of COVID-19 while in the facility. You understand and agree that no one, including, but not limited to Pell Place Homeowners Association, can guarantee that you will not be exposed to SARS-CoV-2 or contract COVID-19. Therefore, you agree to hold Pell Place Homeowners Association harmless for any damage or injury resulting from your potential exposure to SARS-CoV-2 or contraction of COVID-19 from your presence in or use of the Common Area facilities. To the extent that any statements made herein are inconsistent with current government orders, laws, or mandates (collectively “Mandates”), then such Mandates shall prevail.

• Balcony Floors/Surface: Floor coverings such as rugs, mat’s, or astro-turf, can harm the surface of the balconies as moisture and water can be trapped underneath the covering. Only welcome mats of a reasonable size and of an open weave are allowed and these must be relocated periodically. Residents are expressly responsible for the damage caused to the balcony or hallway surfaces.
• Lockboxes: Unless your unit is currently for sale or lease, please be advised that all lockboxes will be removed by Management. Lockboxes can only be placed on the lockbox bar at buildings 3877 and 3887. Building 3857 does not have a location for lockboxes.
• Parking: Parking in guest spaces is limited to 48 hours or vehicle is subject to towing. No residents shall use the guest parking spaces for their automobiles.
• EV Parking: EV parking is available only to residents owning an EV. Please review the rules and be considerate to fellow EV owners.
• BBQ Area: Please follow all posted BBQ rules to ensure this amenity is well maintained for all of residents to use.
• Moving or Have a Furniture Delivery? Contact the HOA office for a Moving/ Furniture Delivery Requirements Form.
• Lock your vehicles: For your protection, please be sure to lock your vehicles when parked on the property and in the garages.
• Bicycles: All bicycles in the garage require a permit. Any bicycles found without a permit will be removed and donated to charity.
• Stairwell doors: It has been discovered that the stairwell doors that exit into the dog run, are often being propped open with rocks & debris. Please be advised that the stairwell doors are to remain closed at all times. Propping the door open is prohibited for any amount of time as it raises the risk of trespassers and lowers the efficiency and effectiveness of the building’s security gates and cameras. It takes the vigilant observation and prompt action of Owners & Residents to prevent accidents and unauthorized access.
• Storage on Patios and Balconies: No Owner or Resident shall use any Exclusive Use Patio Area or Exclusive Use Balcony Area for storage purposes, including, without limitation, the storage of Shoes, Rubbish, Bicycles, Surfboard’s, or other sports equipment. Please refrain from storing rugs, carpets, or turf mats, on your balcony as they hold water & humidity and cause surface deterioration.
• Owners/New Tenant(s): Please ensure you and/or your tenant is aware of the noise that can travel to other units. After 10:00pm, all volume must be significantly reduced as to not disturb other residents. Please ensure you and/or your tenant have a copy of the Rules and Regulations.
• Rules and Regulations: If you need a copy of these as a reminder, please contact your Association’s General Manager, Gennaro Esposito, at Manager@PellPlaceHOA.com. Better to review now and save yourself from warnings in the future.
